INTRODUCTION

The following provisions form the contract governing the relationship between the Buyer and AMES Group Sintering, S.A. (hereinafter AMES), the company responsible for managing the online store www.selfoil.com, with registered address at Ctra. Laureà Miró, 388 – 08980 Sant Feliu de Llobregat - Barcelona (España) and tax no./intra-Community VAT number ESA08382699, entered in the Business Registry of Barcelona, Volume 6663, Folio 5, Sheet B 71390.

The completion of the order by the Buyer implies knowledge and acceptance of the present General Conditions of Sale.

www.selfoil.com will only accept orders from Peninsular Spain, the Balearic Islands, Belgium, Bulgaria, Denmark, Slovakia, Slovenia, Finland, France, Germany, Greece, the Netherlands, Hungary, Italy, Luxembourg, Norway, Poland, Portugal, the Czech Republic, Romania, Sweden, Switzerland and Turkey.

PRICES / ORDERS

AMES takes all necessary steps to provide the information contained on the website truthfully and without typographic errors. If an error of this type occurs in spite of the best efforts of www.selfoil.com, it will be corrected immediately. If a typographic error in any of the displayed prices leads a customer to make a purchasing decision based on this error, we will notify them of the error. The customer will be entitled to cancel the purchase at no cost and the amount of the purchase will be returned. The content of the website may sometimes include provisional information on some products. If the information provided does not correspond to the characteristics of the product, the customer will be entitled to cancel their purchase at no cost.

Orders will be subject to availability of stock but customers may make orders for any quantity, large or small.

TAX

Items purchased through www.selfoil.com are subject to Spanish VAT, which is not included in the initial price of the items.

The Buyer will receive a detailed invoice (tax base + VAT).

For purchases made by companies or professionals with an intra-Community VAT number established in countries or territories belonging to the European Union other than Spain, the sale will be subject to VAT in the country of destination of the goods.

For purchases made by buyers established in other countries or territories not belonging to the European Union, the sale will be subject to VAT in the country of destination of the goods.

CUSTOMS INFORMATION

When you place an order for products on www.selfoil.com for delivery to a country outside the European Union, you may be required to pay import duties and taxes, which will be charged to you when the goods arrives at their destination. Any additional amount due to customs clearance will be chargeable to you.

www.selfoil.com has no control over such amounts. As customs policies vary significantly from one country to another, for more information please consult the corresponding customs office. Please also remember that when you place an order with www.selfoil.com, the law considers you officially as an importer, and you must therefore comply with all applicable laws and regulations in the country in which you receive the product. Customer privacy is a matter of great importance to us, so our international customers should be aware that international shipments are subject to inspection and opening by customs authorities.

FORMS OF PAYMENT

Goods purchased at www.selfoil.com can only be paid by credit card.

Credit card

The system accepts the most common debit and credit cards (VISA and MasterCard). The credit card data provided by the user are treated securely and are not stored in any way by www.selfoil.com. To avoid fraud, operations paid by bank card will not be effective until they have been validated by the issuing bank, after which they will be processed and dispatched.

SHIPPING COSTS

The shipping costs are paid by the Buyer and are included in the invoice under the heading “Shipping costs”. These costs are those published on the website www.selfoil.com.

Once payment has been verified, the products purchased at www.selfoil.com will be sent to the Buyer through the standard parcel service of our carriers.

For purchases made by buyers established in other countries or territories not belonging to the European Union, the sale will be subject to the import VAT established in each case.

DELIVERY OF THE GOODS

The goods purchased by the Buyer will be considered delivered when www.selfoil.com or its logistic agents hand them over to the carrier. The delivery note signed by the customer at the time of receipt of the goods is to all effects the proof of receipt by the customer and acceptance of the delivery.

The Buyer is to all effects the contractor of the transport service and must therefore resolve directly with the carrier any problems (delay in delivery, loss, damage, etc.) that occur during the transport of the goods. For more information, please contact the Customer Service of the carrier chosen in your purchase.

When the goods have been dispatched by www.selfoil.com, the Buyer will receive an email with the dispatch number of their order and the contact details of the carrier. With the data provided, the Buyer can follow their order through the tracking service of the carrier (MRW or UPC according to the place of delivery).

On receipt of the goods, before signing the delivery note, the Buyer should check that it has arrived in good condition and that the content of the package(s) corresponds to the order placed. If the Buyer detects any damage or other irregularities during this check, they should not sign the delivery note and should immediately contact the customer service of the carrier to explain the reasons why they have rejected the delivery. In addition, the Buyer should notify www.selfoil.com of the problem. If the rejection is because the delivery does not correspond to the order placed, the SELFOIL® guarantee bag/seal must be intact. The Buyer should also notify the problem to info@selfoil.com

Shipping address

The goods purchased will be sent to the address specified by the Buyer at the checkout. Any change or notification of an error in the shipping address must be communicated within 24 hours of completion of the order. For orders placed during the weekend or on public holidays in the city of Barcelona (Catalonia, Spain), the notification must be sent by 12:00 hours on the next working day. Unless there is an error in the labelling of the goods, www.sellfoil.com will not be responsible for any expenses incurred by the delivery of the goods to wrong addresses; the Buyer must meet any costs of return and/or reshipment of the goods.

DELIVERY CONDITIONS AND TIMES

The delivery times of the goods vary according to the destination and to several factors over which www.selfoil.com has no direct control. As a guide, the delivery times are generally the following:

Peninsular Spain: 2 to 3 working days. Balearic Islands: 3 to 4 working days.

Other European Union countries: 2 to 3 working days.

Please consult the delivery times for non-EU destinations such as Switzerland before ordering.

If the customer has processed their order and the selected product is not available at that time, the amount paid will be returned immediately and the order will then be cancelled.

GUARANTEE

All products offered at www.selfoil.com have a guarantee of two years from the delivery date according to current legislation. Some parts or products may have a longer guarantee, as will be indicated in the product characteristics.

The guarantee does not cover damage caused by misuse or incorrect handling.

RIGHT OF WITHDRAWAL

The consumer and user has the right to withdraw from the purchase contract during a period of 14 calendar days without giving any reason and without incurring any cost other than the cost of return, which will be paid by the consumer.

The right of withdrawal does not apply to contracts referring to the following:

• A provision of services that has been completely executed if the execution began with the express consent of the consumer and user and with their recognition that they were aware that they would no longer have the right of withdrawal when the contract had been fully executed by the provider.
• The supply of sealed goods that have been unsealed after delivery. The withdrawal period will expire 14 calendar days from the day on which the consumer and user, or a third party indicated by them other than the carrier, takes possession of the material goods requested or:
1. The customer must inspect the products within 48 hours after the delivery, and if they observe any defect in the products, or any other problem related to the supply arises, including erroneous full delivery and non-delivery of one or more products contained in the order, they must notify AMES providing as many details as possible, through info@selfoil.com or the website www.selfoil.com. If the problem arises because the delivery does not correspond to the order placed, the SELFOIL® guarantee bag/seal must be intact. In this case, AMES agrees to remedy the error, in accordance with the order placed and paid, as quickly as possible.
2. If the customer does not provide this notification, it will be assumed definitively that the final products are in all aspects in accordance with the contract and free of any defect that is evident in a reasonable examination and, accordingly, it will be considered that the customer has accepted the products.
3. The customer must reject any packages that are delivered damaged. In this case AMES will replace the damaged shipment with another.
4. Under no circumstances will AMES be obliged to compensate for non-delivery or delayed delivery of all or part of the products for any reason whatsoever, or for any loss, whether or not related, resulting from non-delivery or delayed delivery.

PRODUCT LIABILITY

Definition of a defective product

1. A defective product is understood to be one that does not offer the safety that could legitimately be expected bearing in mind all the circumstances and, especially, its presentation, the reasonable foreseeable use to which it can be expected to be put, and the time of its release.
2. In all cases, a product is defective if it does not offer the safety that is normally offered by the other items in the same series.
3. A product will not be considered defective for the sole reason that this product is subsequently released in an improved form.

PERSONAL INFORMATION

In accordance with the provisions of Organic Law 15/1999 on Personal Data Protection, users will be informed that the information they voluntarily provide to make any purchase will become part of a file owned by AMES Group Sintering, S.A. (AMES) for the purpose of managing the purchase, delivery, after-sales service and customer service. In addition, information on offers and new products will be periodically sent via email unless the user requests otherwise. Each email will contain an address for stating that the user no longer wishes to receive commercial communications.

Users may exercise their rights of access, rectification, cancellation and opposition at any time by sending an email to info@ames.group, specifying in the subject “Ref LOPD”, or by sending a letter by post to Ctra. Laureà Miró, 388 - 08980 Sant Feliu de Llobregat - Barcelona.

Please inform AMES (AMES Group Sintering, S.A.) of any changes in your personal information to help us meet our obligation to keep it exact and up to date.

The user undertakes to provide accurate personal information, and accepts all liabilities for any inaccuracy in the information and/or any manipulation of information on third parties, because AMES will assume that the information has been provided by its holder and is accurate and truthful.

CUSTOMER SERVICE CLAIMS

AMES has a Customer Service Department to which you can address any claims or complaints by writing to info@selfoil.com. When we receive your claim or complaint, we will assign an identification key to it and send you an acknowledgement. AMES will respond to your claim within one month of receiving it.

DISPUTES

Any legal dispute arising from the interpretation of the present General Conditions of Sale will be subject to the jurisdiction of the courts of Barcelona.
